Can I use this program?
To use this program, the following must be true:
- You want to end a marriage or civil union,
- You or your spouse have lived in Illinois for at least 90 days, and
- You do not have another divorce case already filed and still pending somewhere else.
If you have minor children with your spouse, they must have lived in Illinois for the past 6 months.
If your spouse is on active duty with any branch of the US military or lives outside of the US, they must sign an Entry of Appearance form.
What do I need first?
To complete this program, you will need to know the following information:
- Date and place of your marriage or civil union,
- Date you were physically separated,
- City, county, state, and country where you were married or civilly united,
- Current home address for your spouse or other address where your spouse can be found,
- Place of employment for you and your spouse,
- Whether you or your spouse receive Social Security,
- Names and birth dates of all of the children you and your spouse have together or separately, and
- If there are other cases that involve you, your spouse, or the children of you and your spouse, you will need the case number of each, the county and state it was filed in, and whether the case is still active.
You will also need to be able to list:
- All personal property, including bank accounts, that you and your spouse got since you were married,
- All real estate that you and your spouse own or have an interest in, whether together or separately,
- All claims for money for injuries or damages that you or your spouse have suffered,
- All pension and retirement accounts that you or your spouse have, and
- All the debts that you and your spouse have made since you got married.
